In view of the recent judgment passed by Hon’ble Supreme Court in
Sanjabij
Tari Vs. Kishore S. Borcar & Anr (2025) SC 952 , this Court proceeds further with the
matter as otherwise also issuance of notice in pre-cognizance stage has to be dispensed
with.
Perusal of the record shows that the cheque was returned dishonored on
20.03.2024 and legal demand notice was issued on 30.04.2024 meaning thereby it was
issued after expiry of statutory period of 30 days from the dishonor of the cheque.
One opportunity is granted to the complainant to provide clarifications in
this regard.
