Complaint, affidavit of evidence and documents considered in light of
above cited judgment. In opinion of this Court, there is no need to examine the
complainant's evidence for purpose of issuance of process.
Upon perusal of the documents on record, this court is of the prima
facie view that statutory requirements of Section 138 NI Act are met and there seems
to be sufficient ground to proceed against the accused.
Issue summons to the accused for 14.09.2026 on filing of PF, through
approved registered courier/speed post as well as through e-mode i.e. Email for
NDOH.
Complainant is directed to file the process fee and postal envelopes
physically, mentioning the details of the case etc for issuance of summons to the
accused.
Put up for appearance of accused, grant of bail and hearing on notice
under Section 274 BNSS on NDOH at 10 AM. Copy of this order be sent along with
summons.
