The Hon’ble High Court in the judgment of Sanjit Bakshi Vs.
State of NCT of Delhi & anr CRL.M.C. 4177/2019 & CRL. M.A. 34231/2019
observed that “The Court before taking cognizance needs to be satisfied about
existence of prima facie case on basis of material collected after conclusion of
investigation. It is equally important to note that at time of taking cognizance a
Magistrate is not required to consider the defence of the proposed accused or to
evaluate the merits of the material collected during investigation”.
Record perused.
On perusal of the chargesheet, annexed documents i.e. statement
of witnesses recorded u/s 161 of Cr.P.C, FIR etc., it reveals that there is sufficient
material available on record on the basis of which a prima facie case is made out
against the accused person.
I hereby take cognizance of the offence under section 190 (1)
(b) Cr.P.C.
At this stage, it is submitted by parties that they would like to
explore the possibility of settlement in the present case and therefore,
matter may be referred to the Mediation Centre.
Heard. Perused.
Keeping in view the submissions made and nature of offence,
matter be referred to the Mediation Centre on 08.07.2024 at 11:00 AM.
Parties are directed to appear before the Mediation Center.
Put up for report of Mediation on 06.09.2024.
