Present: Ms. Jyoti, Ld. Counsel for complainant.
Accused is absent.
Ms. Shabana Hussain, Ld. Proxy counsel for accused (through
VC).
Despite BW issued against the accused, accused has not appeared
in person before the court.
It is submitted by Ld. Counsel for accused that one opportunity
may be given to the accused to appear before the court. It is submitted by ld.
counsel that accused got the call from the police, however, he was not aware
that in which case he has to appear.
On court query that when the accused and the ld. counsel for
accused were not aware that in which case they have to appear before the court
then how come they are appearing in the present matter through VC to which
no reasonable justification/explanation has been furnished.
Heard. Allowed subject to cost of Rs. 2000/- to be paid to
complainant on the NDOH i.e. 03.09.2026.
It is made clear that if the accused does not appear before the court
in person on the NDOH, court shall be constrained to issue NBW against the
accused.
Put up for appearance of accused on NDOH.
