Present: Ms. Jyoti, Ld. Counsel for complainant.
NBW issued against accused received back with the report that
unexecuted.
It appears that accused is deliberately not appearing before the
court.
In view of the same, the Court is constrained to issue process u/s 82
Cr.PC against accused
In view of the same, process u/s 82 of Cr.PC be issued qua the
aforesaid accused on his last known address with the directions to execute the
same at least 30 days before the date given on filing of PF. The process server is
also directed to ensure the execution of the aforesaid process by:-
1. The proclamation must be read in some conspicuous place of the town or
village in which the person resides
2. It shall also be affixed to some conspicuous part of the house in which
the person resides or to some conspicuous place of the town or village.
3. A copy of the proclamation must also be affixed to some conspicuous
part of the Court house.
Process be issued during the course of the day positively.
Copy of the order be sent to SHO concerned alongwith process for
perusal and compliance alongwith a direction to ensure presence of process
server, who executes process u/s 82 of Cr.P.C, to remain present in person
before the court on 12.02.2027 for recording his statement.
