Present: Ld. Substitute APP for the State.
Accused in person along with Ld Counsel Sh. Jitender.
Ms. Manisha Rawat, Ld. LAC has appeared through VC.
PW Atul and ASI Balraj in person.
As the accused is now represented through private counsel, therefore,
LAC Ms. Manisha Rawat stands discharged.
PW 1 Atul is examined, cross examined and discharged.
It is seen that complainant/PW-1 Atul has failed to identify the accused
Arun as an offender who robbed him. It is a matter of record that except the
complainant, there was no other eye witness to the alleged offence. The remaining
witnesses left to be examined are either police officials or formal witnesses and when
the complainant/only eye witness has already turned hostile and there is no other
witness with respect to identification of the accused Karan, I am of the view that no
useful purpose shall be served in examining the remaining witnesses. Hence, PE
stands closed.
As there are no incriminating evidence against accused, hence SA is also
dispensed with.
Final arguments heard.
Put up for clarifications, if any, and judgment on 22.10.2026.
