RC of defendant no. 1 received back unserved with the
report ‘left’. Counsel for plaintiff filed postal receipt and tracking
report as per which item was delivered to the addressee/
defendant no. 2 on 25.03.2025. Despite service, no one is
responding for the defendant no. 2.
Defendant no. 2 may file WS within statutory period with
advance copy to the other party, who shall file replication before
the next date with advance copy to the opposite party.
The report of the nazarat branch regarding defendant no. 1
is that summons were attempted to be sent on given whatsapp
number but that facility was not available. But the summons were
sent on given e-mail id on 24.03.2025. Counsel for plaintiff may
file any document showing that said e-mail id is being used by
the defendant.
Counsel for plaintiff submitted that his client had taken
dasti summons of defendant no. 1 to Jaipur where the brother of
the director was found and he told that the director had changed
the address. He further submitted that summons be sent on the
same address through the nazarat branch of Jaipur court and this
time his official shall accompany the process server of Jaipur
court in order to know the fresh address of defendant no. 1 from
the brother of the director of defendant no. 1.

Issue fresh summons to defendant no. 1 through the
Nazarat Branch of Jaipur Court, to whom summons shall be
taken dasti, on filing of PF within 7 days from today directing
him to file written statement within 30 days of service.
Plaintiff will ensure that the summons would reach in the
nazarat branch of concerned local court 20 days before the next
date.
After submission of summons in the concerned Nazarat
branch, official of the plaintiff is expected to accompany process
servers for service of the defendant. After service, if possible,
summons shall be taken back by hand from nazarat branch by the
official of the plaintiff.
If official fails to take the delivery of the served or
unserved summons, he is directed to annexe envelope with
stamps with the RC to be sent to the serving court, so that the
said Branch of the court may send the hard copy of the service
report to this court by the next date and soft copy on e-mail id of
this court after service/non-service of the notice. E-mail id of this
court be mentioned in summons itself in bold letter with a
specific direction to the serving branch that service report in soft
form is to be sent on that mail id.
Request letter in the name of the Ld. District Judge, Jaipur
Court be given dasti alongwith summons.
