File taken up today on an application u/o 23 Rule 3 CPC, moved
on behalf of the counsel for the plaintiff.
Plaintiff states that I want to withdraw the present case as the
present matter has been settled out of the court in view of the Settlement Deed
which is now Ex.C-1 (five pages, colly).
Vakalatnama of the counsel for the plaintiff is already on court
record. Plaintiff further prays that the court fees be also refunded to the him, as
per law.
Statement of the plaintiff has been recorded to this effect.
In view of the statement, so recorded, the present suit is hereby
disposed off as withdrawn as compromised out of the court in view of the
Settlement Deed which is now Ex.C-1 (five pages, colly). .
The case is disposed off as withdrawn as compromised out of the
court. In view of the law laid down by Hon’ble Supreme Court of India in The
High Court of Judicature at Madras Rep. By its Registrar General Vs. M.C.
Subramaniam & Ors., SLP(Civil) No.3063-3064 of 2021, the plaintiff be
refunded the court fees paid in the present case, as per law.
The next date of hearing given in the present matter i.e.
02.04.2025, stands cancelled. Abovesaid application moved by the counsel for
the plaintiff, also stands disposed off.
File be consigned to record room after due compliance.
Copy of this order be given dasti, as prayed for.
