plaintiff alongwith plaintiff in person.
Mr. M.C. Verma, Ld. Counsel for defendant no. 1 alongwith
defendant no. 1 in person.
Defendant no. 2 already ex-parte vide order dt. 11.02.2025.
Ld. Counsel for plaintiff submits no replication is to be
filed.
No affidavit regarding admission/denial of documents is
filed.
Now, going through the pleadings and submissions made by
the counsels, following issues as arising are framed:-
i. Whether the suit has not been properly valued for the purpose of
court fees and requisite court fees has not been paid? OPD.
ii. Whether the relinquishment deed dt 19.02.2024 was executed by
the plaintiff under the fraud played by the defendant? OPP.
iii. Whether the plaintiff is entitled for decree of cancellation and
declaration as prayed vide para (I) of the prayer clause? OPP.
iv. Wether the plaintiff is entitled for decree of permanent injunction
as prayed vide para (II) of the prayer clause?OPP.
v. Wether the plaintiff is entitled for decree of permanent injunction
as prayed vide para (III) of the prayer clause?OPP.
vi. Relief, if any.
No other issue is pressed for by the parties. Nor does any
other issue is arising from the pleadings of the parties.

Parties are directed to file list of witnesses within 15 days
from today.
