CNR NO. DLNT01-017152-2025
IA/16/2026 SC-7172/2025
PS CRIME BRANCH FIR NO. 164/2025
STATE V/S JAGSIR SINGH
ORDER ON THE BAIL APPLICATION OF ACCUSED JAGSIR SINGH
17.09.2026
Present: Dr. Raj Rani, Addl. PP for the State.
Sh. Hasim Alam (through VC) and Mohd. Azeem, Ld. Counsels for
the applicant/ accused.
1. This is an application u/s. 483 BNSS for seeking bail on behalf of the
applicant/Jagsir Singh
2. It is argued by Ld. Counsel for the applicant that the applicant has been
falsely implicated in this case. It is further argued that nothing has been recovered
from the possession of the applicant. It is further argued that even other wise, the
alleged recovery of 114.05 grams of heroin is of intermediate quantity, therefore,
section 37 of NDPS Act is not applicable. It is further argued that investigation qua
the applicant has already been completed and charge sheet has already been filed,
therefore, custodial interrogation of the applicant is no more required. therefore, it
is prayed that the applicant be released on bail.
3. The Additional PP for the State with the assistance of the IO argued that the
applicant has also been previously involved in 6 cases, out of which 5 cases are of
NDPS Act. It is further argued that apart from recovery of 114.06 grams of heroin
from the applicant, 401 grams of heroin and 45 grams of MDMA was also
recovered from the co-accused. It is further argued that earlier also, the applicant
has jumped the interim bail granted to him. It is further argued that there is every

likelihood that the applicant may jump the bail, may again indulge in similar crime,
influence the witnesses and hamper the evidence, if released on bail. It is therefore
prayed that his bail application may be dismissed.
4. Heard. Record perused.
5. In the present case, initially co-accused Satpal Singh was apprehended on
the basis of secret information and 401 grams of heroin and 45 grams of MDMA
were recovered from him. Subsequently, during PC remand of co-accused Satpal
Singh, raid was conducted at the house of the applicant and 114.06 grams of heroin
was recovered at the instance of the applicant. The quantity of contraband
recovered from the applicant is of substantial quantity though intermediate. The
applicant is also found involved in 6 previous criminal cases including NDPS Act.
6. Considering the over all facts & circumstances, this court is not inclined to
grant bail to the applicant at this stage. The application is hereby dismissed.
7. Nothing in this order shall tantamount to an expression of opinion on the
merits of the case during trial.
