Present: Sh. Ashok Singh, proxy counsel on behalf of main counsel Sh.
Rajender Kumar, counsel for the applicant / petitioner along with
applicant / petitioner.
This is an application for release of awarded amount filed by the
applicant / petitioner.
As per nazir report, award amount of Rs. 5 lakhs has been
deposited in the State Bank of India, Branch Rohini Court Complex by the Ins.
Co. / respondent.
Statement of petitioner under Clause 29 of MCTAP has been
recorded. Petitioner has opened his MACT SB account with Punjab & Sind
Bank, Branch Jahangirpuri, Delhi having no. 12511000008835. Copy of bank
passbook filed on record (OSR).
Heard and nazir report perused.
Considering the statement of applicant / petitioner and submission
it is ordered that out of the awarded amount Rs. 3 lakhs (along with future
interest accrued thereon) would be kept deposited in MACAD Annuity to be
released to the applicant / petitioner in a phased manner i.e. Rs.10,000/- per
month to be directly credited in his above said account on monthly basis and
remaining amount would be released to the petitioner immediately.
The applicant / petitioner would be allowed to withdraw this
amount only through withdrawal slip and by no other mode or digital mode i.e.
Debit card / Credit card /ATM/NEFT/RTGS/letter etc.
Accordingly, the Manager, State Bank of India, Branch Rohini
Court Complex is directed to transfer the entire award amount along with
interest accrued thereon into the above said bank account of applicant /
petitioner.

The Bank Manager, wherein the applicant / petitioner is
maintaining his bank account is directed to comply with the above direction
with respect to release of awarded amount.
Copy of this order be sent to the above said both the bank
managers through applicant / petitioner for compliance. Copy of this order be
given dasti to the applicant / petitioner.
Application is disposed off accordingly. It be consigned to record
room.
