Present: Applicant / petitioner with Ld. Counsel Sh. S.K. Sengar.
This is an application seeking release of 40% of the awarded
amount in terms of order dated 04.08.2017 passed by the Hon’ble High Court.
Separate statement of petitioner has been recorded to this effect.
Submission heard and record perused.
The award was passed in the present matter way back on
05.05.2017 against which Ins. Co. preferred an appeal and vide order dated
04.08.2017, the Hon’ble High Court directed the Ins. Co. to deposit the
awarded amount and direction were given to the Tribunal to release 40% of the
awarded amount.
As per Ld. Counsel, the appeal is still pending before the Hon’ble
High Court. However, apart from order dated 04.08.2017, no further order has
been filed along with the application and even main file has not been received
back from the Hon’ble High Court. As per Ahlmad, no order has been
received from the Hon’ble High Court. Accordingly, Ld. Counsel for the
applicant is asked to file present status of the appeal.
Be put up for consideration on the application / further
proceedings on 25.03.2026.
