An application under Order VII Rule 11 CPC has been
filed by defendant on the ground that present commercial suit for
eviction, recovery of arrears of rent etc. is in respect of
commercial property situated at C-37, Madhu Vihar, Delhi,
which comes within the territorial jurisdiction of East District,
Karkardooma Courts.
In view of the ground as taken, counsel for the plaintiff has
separately moved an application under Order VII Rule 10 and
10A CPC, seeking return of the present plaint with the liberty for
plaintiff to file the suit before the court of competent jurisdiction.
Counsel for plaintiff submitted that pre-litigation mediation has
already been carried out in North District.
In view of the above said fact since the property in respect
of which relief has been sought is not situated within the
jurisdiction of North District, plaint is ordered to be returned to
plaintiff with court fee for filing the present suit before the
Commercial Court of East District, Karkardooma.
File be consigned to record room.
