There is only one defendant which has been impleaded through its two directors and summons of both directors received back, which were sent on their common address, unserved with the report that when the process server visited on 03.04.2025 he came across a person namely Vikas Kager who told that Shri Kewal Ahuja and Shri Raju Dharke were not there and Shri Kewal Ahuja had shifted to Gurgram after January 2025. Vakalatnama has been filed on behalf of defendant no.1 by Shri Vineet Jindal saying that his client had received summons through post on 04.04.2025. Counsel for plaintiff has not filed any tracking report. Counsel for plaintiff has moved an application U/s 151 CPC for waiving of cost and the same is dismissed because no reason is made out for allowing the same. The matter is now adjourned for filing the receipt of deposit of cost of Rs.5,000/- and defendant may file WS within statutory period with advance copy to the other party, who shall file replication before the next date with advance copy to the opposite party. -- 1 of 2 -- The matter is now adjourned for above purpose and for filing affidavits of admission/denial of documents and for framing of issues on 23.07.2025.
