holiday by the Hon’ble High Court of Delhi.
Present: Sh. Sachin Adhikari, Ld. Counsel for plaintiff.
None for defendant.
It has been pointed out by the Ld. Counsel for
plaintiff that the plaintiff has expired on 03.12.2025 and he has
moved an application under Order 22 Rule 3 CPC for bringing on
record the LR’s of the deceased plaintiff.
This is a commercial suit for recovery filed by the
deceased plaintiff. Having considered the averments made in the
application, right to suit survives upon the LR’s of the deceased
plaintiff, therefore, being son and daughters. It is stated that one
of the daughters i.e., LR No.4 Smt. Sanju Kumari is missing
since the last 13 years. In view of the submissions, the
application is allowed and the LR’s of the plaintiff are impleaded
as parties and the amended memo of parties is taken on record.
Issue summons for settlement of issues and notice of
the application, if any, to the defendant through e-mail,
WhatsApp as well as by ordinary process, registered post, speed
post and approved courier returnable on 16.07.2026, subject to
filing of PF, deposit of necessary charges within 07 working days
directing the defendant to file written statement / reply within
statutory period. To come up for 16.07.2026.
