This is an application under Order IX rule 4 CPC for
restoration of restoration application which was dismissed in
default on 10.09.2024.
The restoration application was fixed for 10.09.2024 and
the same was dismissed in default due to non-appearance of any
person on behalf of the applicant. The applicant’s counsel had
noted the next date as 09.10.2024 and that is why no one could
appear for the applicant. In view of that proper explanation, the
application is allowed subject to payment of cost of Rs. 5,000/- in
favour of DLSA, North and the receipt is to be filed on the next
date in main case.
The restoration application is restored to its original
number and position.
The application file be consigned to record room after
keeping copy of this order on the file of restoration application.
