Present : None for the applicant Manjeet S/o Naresh Kumar.
The applicant has filed two applications. The one is
u/o 22 Rule 3 CPC for impleading the LRs of IP No. 3 (i) Naresh.
It is supported with the SMC and death certificate of said Naresh.
The same is accordingly allowed.
The said IP Naresh is survived by wife Raj Dulari,
daughters Indu, Nisha and Rekha and one son Manjeet. This IP
Naresh is the successor of deceased IP No. 3 Meer Singh @
Mehar Singh @ Mehru who had died during the reference
proceedings whereafter his LRs including the said Naresh and
four daughters namely Prem, Sudesh, Geeta and Santosh were
substituted. Now the applicant Manjeet S/o IP Naresh has also
moved an application u/s 152 CPC on the basis that all the
aforesaid daughters of IP 3 Meer Singh and IP 3 (i) Naresh have
executed registered RD in his favour. In view of this RD, the
applicant Manjeet has now become entitled to the entire share of
IP 3 Meer Singh @ Mehar Singh @ Mehru in respect of the
Award amount. In view of these circumstances and the registered
RD lying on record, the application u/s 152 CPC is allowed. The
award amount payable to IP No. 3 Meer Singh @ Mehar Singh
@ Mehru now be released to the applicant Manjeet.
The aforesaid application stands disposed off.
