As per record, no reply/WS has been received on behalf of
respondent no. 1&2 till date despite according multiple opportunities. In
these circumstances, their right to file any WS is hereby struck off.
WS on behalf of respondent no. 3/Ins. Co. already
received. Accordingly, pleadings are complete. From the pleadings of
the parties, following issues are framed: -
1. Whether injured / petitioner Narender Kumar Gupta suffered
injuries in a vehicular accident occurred on 31.03.2024 at
about 08:00 PM near Himayun Pur, within the jurisdiction of
PS IMT Rohtak, Haryana, due to rash and negligent driving of
vehicle i.e. Tractor bearing registration No. HR10AR2993 by
respondent no. 1 (Sumit), owned by respondent no. 2 (Amit
Kumar) and insured with respondent no. 3 (IFFCO Tokio Gen.
Ins. Co. Ltd.)? OPP.
2. Whether the petitioner is entitled to compensation if so, what
amount and from whom of respondents? OPP.
3. Relief.
Parties to file list of their witnesses within one week from
today. Petitioner to file his affidavit and affidavits of his witnesses (if
any) before next date, with advance copy to the respondents.
