RAJBIR SINGH Vs. BHUPENDER SINGH AND ANR.
22/07/2025
Present : Sh. Ashutosh Mishra, Ld. Counsel for plaintiff.
Sh. Manoj Kumar, Ld. Counsel for defendants no. 1
& 2.
Ld. Counsel for the plaintiff has filed reply to application
seeking condonation of delay. Replication and affidavit of admission-denial
of documents. Copy supplied.
Ld. Counsel for the defendants presses his application dated
04/04/2025 for condonation of delay in filing Written Statement.
It is argued by Ld. Counsel for the defendants that procuring
of documents took time and hence delay occurred.
Per contra, Ld. Counsel for the plaintiff states that there is a
delay of approximately 60 days in filing the Written Statement. Defendants
are in possession and are delaying the case.
Heard. File perused.
Perusal of memo of parties shows that defendant no. 1 is son
and defendant no. 2 is daughter-in-law of the plaintiff. Perusal of Written
Statement shows that from page 18 to 83 documents have been annexed by
the defendant. The procuring of the same may have taken time. The
defendants must be given a chance to contest the suit on merits. Plaintiff can
be compensated byway of cost for delay. The Written Statement is taken on
record after condonation of delay, subject to cost of Rs. 2,500/- to be paid by
defendants to plaintiff by way of Demand Draft well before the next date of
hearing.
At request of Ld. Counsel for the defendants to come up for
affidavit of admission-denial of documents on behalf of defendants and
framing of issues on 11/09/2025.
