Sh. Manoj Kumar, counsel for the defendants.
Counsel for the plaintiff presses his application
dt.09.08.2024.
It is argued that third party interest be not created by
the defendants till the pendency of the suit.
Counsel for the defendants states that plaintiff is father
of defendant No. 1. Defendant No. 2 is daughter in law of the
plaintiff. Defendants are in possession of the suit property.
Defendants undertake not to create any third party interest in the
suit property.
Heard. File perused.
It is necessary to protect the subject matter of
litigation during pendency of the case. Keeping in view the
relationship between the parties and no objection by defendants,
the defendants are restrained from creating any third party interest
in the suit property i.e. shown in green colour in the site plan of the
property bearing No. 108 out of Khasra No. 23/2, 2nd floor, Street
No. 13, Sushant Vihar, Ibrahim Pur, Delhi-110036 measuring
49.1/2 square yards.

Application u/o 39 rule 1 & 2 CPC is disposed off in
the above terms.
Counsel for the plaintiff points out that there is a delay
of about 80 days approximately in filing written statement by the
defendants. Counsel for the defendants states that he will file an
appropriate application in this regard with copy to counsel opposite
immediately.
At request of the counsel for the defendant, to come up
for completion of pleadings, filing of affidavit of admission/denial
of documents and framing of issues on 22.07.2025.
