Vakalatnama has been filed on behalf of the defendants today
itself.
Let written statement be filed by the defendants within the
statutory time limit with advance copy thereof to the opposite counsel.
Counsel for the plaintiff presses his application u/o 39 rule 1 and
2 CPC.
It is argued that defendants are in the possession of the suit
property. It is argued that no third party interest be created by the defendants.
Sh. Bhupender Singh, defendant no.1 states that he will not
create any third party interest till the next date of hearing.
Statement of the defendant no.1 has been recorded separately to
this effect.
Defendants are restrained from creating any third party interest
till the next date of hearing to preserve the suit property during litigation.
At the request of the counsel for the defendants, for completion
of pleadings of the parties and for addressing the arguments on the injunction
application of the plaintiff u/o 39 Rule 1 and 2 CPC on 03.04.2025.
Reply, if any be filed to the application u/o 39 rule 1 and 2 CPC
with advance copy thereof to the opposite counsel
