Charge has already been conceded on behalf of accused
Rafat and Saurabh @ Gaurav.
Arguments on charge qua accused Sonu, Shanti and
Sanjay Mandal have already been heard.
It is argued on behalf of accused persons that they have
been falsely implicated in the present case and they have nothing to do
with the present offence.
Heard. Record perused.
As per the case of the prosecution, accused Saurabh was
found in possession of 160 grams of smack and at his instance,
accused Sonu was arrested with 150 grams of smack. Accused
Saurabh used to work for accused Sonu and Shanti. During
investigation, accused Rafat Hussain was arrested and 275 grams of
smack was recovered from his house. Accused Sanjay Mandal did not

join investigation and absconded and he was declared proclaimed
offender vide order dated 15.10.2024. There is sufficient material
on record to show that all the accused persons were involved in
criminal conspiracy for trafficking of smack. Therefore, prima facie
case is made out to frame charge under section 29 of NDPS Act
against all the five accused persons ; charge under section 21 (b) r/w
section 29 of NDPS Act against accused Saurabh @ Gaurav ; under
section 21 (b) / 25 r/w section 29 of NDPS Act against accused Sonu ;
under section 21 (b)/ 25 r/w 29 of NDPS Act against accused Rafat
Hussain and section 174 A (1) IPC against accused Sanjay Mandal.
Separate Charges have been framed against all the accused persons to
which they pleaded not guilty and claim trial.
Put up for PE on 16.09.2025 and 26.09.2025.
Complainant, duty officer, IO and MHC (M) be
summoned for 16.09.2025.
ACP Arvind Kumar, ASI Gajraj and ASI Mukhtiyar
Singh alongwith MHC (M) be summoned for 26.09.2025.
