None for defendant no. 3 (defence already struck off).
An application under section 151 CPC for recalling of order dated
04.09.2025 and for restoration of WS is filed on behalf of defendant no. 1. Copy is
supplied.
It is submitted by Ld. Counsel for plaintiff that no reply to this
application is to be filed and the application is intended to be argued orally.
Accordingly, arguments are heard. Application is opposed on the ground of delay
but considering the reasons stated in the application, this delay in payment of cost
is condoned and subject to payment of cost today itself, WS is taken on record.
Today, cost is paid.
Copy of application under Order 1 Rule 10 CPC is not supplied to the
plaintiff by defendant no. 2 till time. For such ommission, defendant no. 2 is
hereby burdened with a cost of Rs. 2000/-, out of which Rs. 1000/- is directed to
be paid to the plaintiff and Rs. 1000/- is to be deposited in Rohini Court Bar
Association in Account no. 30330097344, State Bank of India, IFSC Code :
SB1N0010323. Subject to deposit of said cost, let the copy of the application be
supplied within two weeks against acknowledgment. Thereafter, reply to the
same, if any be filed after supplying copy to the opposite counsel.
