Affidavit of service filed on behalf of the plaintiff by the
Ld. Counsel for the plaintiff himself.
Defendant nos. 1 and 2 have been served through E-
mail on 17.08.2026 and by speed post on 20.08.2026 to defendant no.
1 and on 21.08.2026 to defendant no.2. But no WS has been filed till
date either by defendant no. 1 or 2.
Ld. Counsel for the defendant submits that they have not
been supplied the copy of the plaint. But the E-mail shows that a pdf
file has been sent to the defendants. The version of Ld. Counsel for
defendant no. 1 would have been different, if the defendant no. 1
would have approached the Court or to the plaintiff within 30 days of
its service qua deficient or non supply of the plaint. The submissions
made by Ld. Counsel for defendant no. 1 qua non supply of copy of
the plaint is not accepted. However, informally, Ld. Counsel for the
plaintiff submitted that he will supply the copy again to the Ld.
Counsel for the defendant.
Though, as per Commercial Court Act, the stipulated
period of 30 days is prescribed for filing the written statement has
completed. However, the outer limit of 120 days for filing the Written
Statement is yet to be completed.
Put up for status of filing of WS, if any/further
proceedings on 28.01.2027.
