Report received on behalf of IO. Perused.
It is an admitted position that the statutory period for filing
the DAR has been lapsed in the present matter i.e. FIR No. 76/2025 PS
Bawana was registered on 10.02.2025. In these circumstances, inquiry is
required to be conducted by the DCP concerned for fixing the liability
and accordingly, notice be issued to the DCP concerned for sending the
outcome of the proceedings to be initiated against the delinquent police
official, to be sent to this Tribunal as and when DAR would be filed.
Further, the liability of the delinquent police official would be fixed
under the Delhi Police Act as per the scheme formulated by the Hon'ble
High Court of Delhi for the Motor Accident Claims, on filing of DAR.
Considering the above, present application stands disposed
off and concerned Ahlmad is directed to tag the present application with
the DAR as and when filed by the IO.
Copy of this order be sent to DCP concerned for
information and necessary action.
