Counsel for petitioner Fresh petition u/s 34 Arbitration & Conciliation Act received challenging exparte arbitral award dated 27.03.2026. It be checked and registered. Petition is accompanied with another application u/s 36(2) seeking stay of operation of impugned exparte award dated 27.03.2026. It is pointed by the counsel for the petitioner that as is evident from the prayer granted under the award Ld. Arbitrator has directed the respondent/petitioner herein to hand over the vehicle in question in case it has not already been possessed and also given liberty to respondent herein to dispose off that vehicle. Considering the submissions made, inter alia stated that very appointment of arbitrator is bad in law as the arbitration clause contained unilateral authority to claimant/respondent herein to appoint arbitrator of their own choice. Operation of the award is ordered to be stayed till the disposal of the present petition. Let notice of the petition be issued to the respondent.
