Heard. Record perused.
This is a suit filed by plaintiff seeking mandatory injunction. In para
no. 31 of the plaint, the valuation of the suit for the purpose of jurisdiction has been
made at Rs. 130/- which is much below than the pecuniary jurisdiction of this court
and this court is of the view that it ought to be decided by Ld. Senior Civil Judge,
North District, Rohini, Delhi and the inclination of this court to return the plaint
under Order 7 Rule 10 CPC is also informed to Ld. Counsel.
Ld. Counsel for plaintiff prays that as per Order 7 Rule 10A CPC, the
suit may be placed before Ld. Principal District & Sessions Judge, North District,
Rohini Courts so that same may be withdrawn from this court and assigned to the
court of Ld. Senior Civil Judge, North District, Rohini Courts, Delhi.
So, let the present matter be placed before the Ld. Principal
District & Sessions Judge, North District, Rohini Courts, Delhi with the request
to withdraw the present suit from this court and assign the same to the court of
Ld. Senior Civil Court, North District, Rohini, Delhi.
Plaintiff is directed to appear accordingly on 31.07.2026 at 02.00
PM.
Ahlmad is directed to send the file complete in all respects.
