Present: Sh. P.S. Singal and Sh. Rakshit Gupta, Ld. Counsels
for the appellant through VC.
Appellant in person.
Heard. Perused.
1. The present appeal is filed against judgment dated
25.05.2026, whereby, the appellant has been convicted for
offence punishable under section 138 NI Act and order on
sentence dated 09.07.2026, whereby, the appellant/convict has
been sentenced to “
simple imprisonment for a period of 6
months and is further directed to pay fine equal to the amount of
cheque at the interest @ 9% per annum from the date of filing of
the complaint till the realization of the amount and the entire
amount shall be payable to the complainant as compensation
within 30 days. In default of payment of said amount /
compensation, convict shall be further liable to imprisonment for
a period of 30 days”.
2. Alongwith the appeal, an application for stay /
suspension of the sentence has also been filed. The sentence
imposed upon the appellant is suspended till the next date of
hearing subject to depositing 20% of the compensation amount
(either in the form of FDR or DD) in the name of the Ld. Trial
Court. Appellant is further directed to furnish PB/SB in the sum

of the Rs. 25,000/- before Ld. Trial Court concerned.
3. TCR be summoned only one day prior to the next
date of hearing.
4. Notice be issued to the respondent on filing of PF
and RC. PF be filed within 7 days from today.
5. Let copy of this order be sent to the Ld. Trial Court.
6. Put up for further proceedings on 29.09.2026.
Copy of the order be given dasti, as prayed.
