Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: 7 CS DJ 620/23 SWATI SHARMA Vs. USHA SHARMA
26.11.2025.
Present : Mr. Ashok Kumar, Ld. Counsel for the plaintiff
alongwith plaintiff.
Mr. Shailender Bhardwaj, Ld. Counsel for the defendant
alongwith husband of defendant.
At the outset, producing the judgement passed by
Hon’ble High Court of Delhi in “Smt. Usha Sharma and Another Vs.
Swati Sharma, CRL MC No. 1442/2023”, it is stated that plaintiff is
not entitled for any kind of relief. Perusal of the same does not show
that her entitlement for any kind of relief is declined.
On the last date, parties were directed to appear in
person. Pleadings itself speak that only reason of the Court asking
the parties to appear was that they are the part of family but
defendant has not appeared. On the contrary, alleging dis-obedience
by the plaintiff, it is constantly stated on behalf of defendant that no
chances for amicable settlement even could be explored. From this
very conduct and that omission in appearance is made be defendant
and rather her husband is made to appear in Court, it is clear that
defendant is not inclined at all to even give a thought for any
settlement but orally a web of dis-entitlement of plaintiff is being
moven to gain time to frustrate the object of suit.
So without waiting, further replication, if any, is
directed to be filed after supplying advance copy to the opposite
counsel against acknowledgment. Affidavit qua admission and denial
of the documents, if any be also filed by the next date.
Now, put up for framing of issues for 24.03.2026.
