Present : Petitioner with counsel Mr. R.D. Dubey and Mr.
Aijaz Ahmad.
The present transfer petition was received on self
allocation on 21.08.2023, when the court was on leave. The same
be checked and registered, as per rules.
Heard.
It is stated that the present applicant/petitioner
Chander Kesh, is an accused in case FIR no. 358/2018 u/s
307/323/34 & u/s 25/27 of Arms Act, PS Narela, which is now
pending before the court of Sh. Dhirender Rana, Ld. ASJ, North,
Rohini, Delhi, and is listed for 26.09.2023.
The cross case instituted, at his instance, bearing
FIR No. 359/2018 u/s 323/324/325/341/506/34 IPC, also PS
Narela, is pending disposal before the court of Sh. Jitender, Ld.
MM, North, Rohini Courts, Delhi. It is staed that both the cases
are cross cases, and that for an efficacious disposal of both the
cases, both the cases be tried by the same court.
It is prayed that the case, pending before the court of
Sh. Jitender, Ld. MM, North, Rohini, Delhi, be also transferred to
the court of Sh. Dhirender Rana, Ld. ASJ, North, Rohini, Delhi.
Let a report be called from the SHO PS Narela, in
respect of FIR Nos. 358/2018 and 359/2018, with a specific
query as to whether the said cases are cross cases, or not.
IO of the case, sought to be transferred, shall also
appear in person on the next date of hearing.
