conferencing.

Summons issued to PW ASI Mukhtiyar received
back with the report that he is on leave.
It is submitted by Ld. Counsel for accused Vishal
that accused Vishal is appearing through video conferencing as
he cannot appear physically in the court today on account of
illness.
Heard.
PW-2 HC Anurag is examined in chief, cross
examined and discharged.
PW ASI Shashikant is discharged unexamined for
today as it is lunch time and in the post lunch session, public
witnesses are to be examined in other cases.

At this stage, an application under section 311 Cr.
PC has been moved on behalf of accused Rohit Khatri for
recalling of PW1 SI Ravinder Chander stating that on
15.10.2024, cross examination of PW1 SI Ravinder Chander
could not be done by main counsel as he was not well on the said
date. Copy of medical documents is also annexed with the
application.
Another application under section 311 Cr. PC has
been moved on behalf of accused Vishal stating that on
15.10.2024 cross examination of PW1 SI Ravinder Chander
could not be conducted by Sh. Nitin, Ld. Counsel for accused,
who was present on the said date as he had an appointment with
the doctor. The medical documents of Ld. Counsel are also
annexed with the application in support of the submission made.
Heard. Record perused.
In view of the submissions made by Ld. Counsels,
both the applications under section 311 Cr. PC are allowed and
disposed of. PW-1 SI Ravinder Chander be summoned for his
cross examination for next date of hearing.
PW ASI Shashikant and MHC (M) be also
summoned for NDOH.
Put up for PE on 01.04.2025.
