Present: Ms.Seema Gupta, ld. counsel for the plaintiff.
Sh.Pushpak Shukla, ld. counsel for defendant.
Matter is listed for making the payment of cost of
Rs.20,000/-, imposed upon defendant vide order dated
23.02.2026 whereby delay of 85 days in filing of WS was
condoned on application of defendant under Order VIII Rule 1
CPC. Today an application has been moved seeking waiver of
the cost.
Considering the submissions made by ld. counsel for
defective, cost of Rs.20,000/- is ordered to be reduced to
Rs.15,000/-, subject to condition of depositing of same with the
plaintiff today itself.
Today counsel for the defective has given the statement
separately recorded that his client is not willing to pay even the
reduced cost. In view of such defendant, defence of the
defendant struck off. Defendant can participate in the
proceedings to raise legal issues.
In the interest of justice a basic issue is being framed as
under :
Whether the plaintiff is entitled for recovery
of sum of Rs.9,36,213/- with pendente lite
and future interest, if so at what rate? OPP
