Shri Chetan Wahi, Counsel for defendant. WS to the amended plaint, statement of truth, affidavit of admission/denial of documents with list of documents and documents filed by defendant earlier on 07.03.2025, are already on record. The plaintiff filed replication with affidavit of admission/denial of documents. On the index page, it is mentioned that the plaintiff filed some documents also. But those documents have been returned to him as he has still not brought permission of the Court for that purpose. Two different applications moved by plaintiff U/o 13A and U/o 12 Rule 6 CPC and U/o 15 Rule 5 read with Section 151 CPC filed on 12.03.2025 are already on record. Copy supplied. Counsel for plaintiff submitted that a local commissioner may be appointed to visit the suit property at his own expenses so that the belongings/material, if any, of defendant, are lying in the suit property may be removed in his presence. Counsel for defendant submitted that he has no objection if local commissioner was appointed for the aforesaid purpose and a date and time may be fixed for his visit to the suit property. -- 1 of 2 -- In view of submissions made by counsel for parties, a local commissioner Shri Pareekshit Bishnoi Advocate, Mobile No.9439474094, 8439674094 is appointed, who is directed to visit the suit property i.e. E-9 Vijay, Nagar, First Floor, Second Floor, Third Floor and Fourth Floor on 02.05.2025 and 03.05.2025 at 2:00 p.m. and he will remain there till 7:00 p.m, till the belongings/matrial of the defendant are not removed from the suit property. His fees is fixed at Rs.30,000/- which shall be paid by the plaintiff. The Local Commissioner is directed to file his report before the next date of hearing.
