Present: Mr. Aayush Kuchhal, Advocate for plaintiff.
None for defendant.
Counsel for plaintiff submits that he wants to
withdraw the present suit as the matter has been settled with
defendant. He has filed copy of MOU dated 25.12.2025 (original
has been filed in another matter bearing CS Commercial
(452/2025) wherein the defendant has agreed to settle the matter
with the plaintiff and he will pay a total sum of Rs.4,60,000/- and
out of the said settlement amount of Rs.3,50,000/- has already
been paid by the defendant in cash on the said date i.e.
25.12.2025 and Rs.1 lakh was paid through NEFT on the same
date and today the balance amount of Rs.10,000/- has been paid
by the defendant to the plaintiff through NEFT.
Now since the defendant has complied with the
terms and conditions of aforesaid MOU and the plaintiff now
wants to withdraw the present matter. Let statement of counsel
for plaintiff be recorded in this regard separately.
Statement of Shri Aayush Kuchhal, counsel for
plaintiff recorded.
In view of the statement of counsel for plaintiff, the
suit is disposed of as settled as withdrawn.
