Present : Appellant in person with counsel Mr. Vineet Rana.
Respondent in person with counsel Ms. Yashasvi.
Arguments on the appeal heard in part. To facilitate
the disposal of the instant appeal, both the parties have been
examined by the court u/s 165 Evidence Act and their statements
have been recorded separately.
During the course of arguments, it is submitted that
the respondent is suffering from 90% limbs upper disability.
However, since the respondent has appeared in person in the
court and his statement has been recorded, the court has observed
that the respondent is a man of able and very good understanding
and is using his hands for various purposes including adjusting
his mask and jacket etc.
Conciliation carried out and since there appears to
be an element of an amicable settlement, vide separate referral
order, matter is referred to the Mediation Cell, Rohini, with
directions to the parties to appear before the InCharge,
Mediation Cell, Rohini Courts, Delhi, on 30.01.2024 at 12.00
Noon.
Parties shall appear before this court for reporting
the settlement, if any, or in the alternative for further arguments
on 24.02.2024.
