The amended written submissions and amended
application u/o 1 rule 10 CPC is taken on record subject to all just
exceptions.
Proxy Counsel for the defendant no.2 presses his
amended application dated 01.12.2025 for deletion of name of
defendant no.2.
Counsel for the plaintiff states that let defendant no.2
supply details of exact amount released to defendant no.1 from two
Bank Accounts of Sh. Rajat Gupta as detailed in para no.17 of the
amended written submissions. Thereafter, plaintiff will have no
objection to deletion of name of Yes bank.
Counsel for the defendant no.2 states he will file
affidavit of responsible officer of the bank giving details of exact
amount released to defendant no.1 from two Bank Accounts of Sh.
Rajat Gupta as detailed in para no.17 of the amended written
submissions alongwith account transfer details well before the next
date of hearing with advance copy thereof to the opposite counsel.
At request of the counsel for the defendant no.1, to
come up for disposal of amended application u/o 1 rule 10 CPC, on
27.02.2026.
