Fresh execution petition received by way of
assignment. It be checked and registered.
Present: Ld. Counsel for the DH.
Civil Nazir to report. District Nazir report be also
obtained. Submissions heard.
This is an execution of the award u/s 26 of the LA Act.
Ld. Counsel submits that despite lapse of a considerable
time after the award, the LAC has not remitted the amount of
compensation as awarded by this Court. He requests for issuance
of warrant of attachment against the properties of the JDs.
Submissions considered. In the interest of justice, notice of
petition be issued to the JDs on filing of PF/RC. The beneficiary
department of the acquisition is directed to positively remit
the decreetal amount as per District Nazir report.
Be clarified that in case the amount is not remitted by
next date of hearing, coercive measures shall be initiated
forthwith against the beneficiary department.
LAC shall also file ENM by next date of hearing &
Civil Nazir is to reconcile the same with the report of District
Nazir. In case of any discrepancy, the same be highlighted.
