Matter is listed for disposal of an application moved by
plaintiff under Order XI Rule 1 (5) CPC seeking to place on
record certain additional documents. It is mentioned that in view
of the pleadings of the defendant in the WS, while disputing the
pleading, however plaintiff intends to place on record certain
documents to counter the defence. Documents are copy of
reconstructed partnership deed, letter dated 24.05.2023 regarding
change in constitution of firm M/s Systems India.
Ld. counsel for the defendant opposed the application by
submitting that the documents sought to be placed on record
were very much in possession of the plaintiff and could have
been placed on record at the time of filing the plaint.
Having considered the submissions, taking note of the
facts arising out of the pleadings, since the issues in this case are
yet to be framed and defendant would get an opportunity to admit
or deny the documents being taken on record, accordingly
application is being allowed, subject to cost of Rs.2,000/-.
Put up now this case for filing of affidavit of admission/
denial from plaintiff as well as from defendant to the additional
documents, framing of issues, payment of cost on 22.04.2026.
