Ld. Counsel for insurance company submits that he shall file
investigator report within two days. Let copy be supplied in advance to opposite
party.
Pleadings are complete in the matter. On the basis of the pleadings of
the parties following issues are settled for consideration:-
1. Whether the damage caused to Vehicle i.e.
Hundai Creta, bearing registration No. HR 10AA 5834
was on account of Motor Vehicular Accident which,
which occurred on 27.05.2022 at about 8.30 PM on
traffic red light Siraspur Gurudwar, GT Karnal Road,
on the road going towards By pass to Alipur, on
account of the rash and negligent driving of Eicher
Canter bearing registration no. UP-19T-8145 by
respondent no. 1/driver, owned by Maneesh Singhal
and insured with IFFCO Tokio General Insurance
Company Ltd./R3?OPP.
2. Whether the petitioner is entitled to any
compensation on account of the damage caused to PCR
van aforesaid? if so, to what amount and from whom?
OPP.
3. Relief.
No other issue arises or pressed.
Put up for PE on 29.08.2024. List of witnesses, if any be filed by
both the parties within 2 weeks. Evidence by way of affidavit on behalf of
petitioner be filed within 4 weeks after supplying the advance copy to the
respondents through counsel against receipt.
