No written statement is filed on behalf of the
defendant till date.
Perusal of record shows that defendant was served
with summons in the present case on 08.06.2023. Thereafter, on
02.09.2023, directions were given to the defendant to file WS
within 30 days. However, till date defendant has not filed the
written statement nor any advance copy of the same is supplied
to Ld. Counsel for the plaintiff despite specific directions in this
regard. In these circumstances, right of the defendant to file
written statement stands closed and suit of the plaintiff stands
decreed under Order VIII Rule 10 CPC.
