File taken up today on the application qua setting
aside the order for dismiss-in-default of suit vide order dated
25.01.2024.
File perused.
The plaintiff had not appeared on 14.07.2023 and
thereafter case was adjourned for 17.11.2023. But on 17.11.2023
plaintiff was also not appeared and case was adjourned for
25.01.2024. On 25.01.2024, none had appeared and suit was
dismissed in default.
I have gone through the contentions as asserted in
the application.
The application is not supported with any documents
qua illness of previous counsel. Even it reveals that plaintiff has
not come forward for three consecutive dates to know about the
status of his case. But, keeping in view the facts and
circumstances of case and to adjudicate the case on merits as the
defendant has not been served so far, the application stands

allowed by imposing a cost of Rs. 40,000/- upon the plaintiff, out
of which Rs. 10,000/- shall be deposited with Rohini Court Bar
Association, Welfare Fund, Rs. 10,000/- with Civil & Sessions
Court Stenographer Association, Delhi, Saving account no.
0613000100079946 maintained with Punjab National Bank,
Gokhale Market, Delhi-110006, Rs. 10,000/- with Distt. &
Sessions Courts Employees Welfare Association, Saving account
no. 38222714058, Branch Tis Hazari, Delhi and Rs. 10,000/-
with DLSA (North), Rohini Courts, Delhi.
After placing on record the receipts, issue summons
of the suit to the defendant(s) on filing of PF through all
permissible modes, returnable on 31.08.2026.
Suit be restored to its original number.
Steps be taken within 2 weeks from today.
