Fresh appeal has been received by way of assignment. It be
checked & registered.
Present: Sh. Birender Sangwan, ld. counsel for the appellant.
Along with the appeal, an application u/s 389 of CrPC for
suspension of the sentence and for grant of bail during pendency of appeal
has been moved on behalf of the appellant convict.
Heard.
Since the offences alleged against the appellant were bailable
and the appellant was also released on bail by the ld. Trial Court after his
conviction, therefore considering the totality of the facts and circumstances,
the operation of impugned order on sentence dated 29.03.2023 is suspended
till the disposal of the appeal and the appellant is admitted to bail on
furnishing personal bond in the sum of Rs. 20,000/- with one surety in the
like amount till pendency of the appeal. The application is disposed of
accordingly.
Ld. counsel for the appellant seeks time to furnish the bail
bond and surety bond. He is directed to furnish the same on or before
the next date of hearing.
Let a copy of the order be sent to ld. Trial Court
for information. Copy of the order be given dasti to the ld. counsel for the
appellant.
TCR be requisitioned.
Issue notice of the appeal to the State for the next date.
Put up for arguments on appeal 26.07.2023.
