WS, Statement of truth, affidavit of admission/denial
to the plaintiff’s documents, copies of documents along with list
as well as application seeking condonation of delay in filing the
WS filed on behalf of the defendant.
Hard copy placed on record for the plaintiff. Let the
same be collected.
There is a delay of around 10 days in filing the WS
which, as per the defendant, occurred as the defendant is a
resident of Himachal Pradesh and it took time to give instructions
to the counsel at Delhi with documents relating to 2016 to 2020.
In order to decide the case on merits and considering that WS has
been filed in the outer limit of 120 days, the delay is condoned.
The application seeking condonation of delay in filing the WS
stands disposed of. WS etc. are taken on record.
The plaintiff is directed to file the affidavit of
admission/denial to the defendant’s documents as well as
replication, if desired, to the WS within four weeks with advance
copy to the other side.
Put up for admission/denial, framing of issues and
case management hearing on 10.07.2025.
