Counsel for the plaintiff. Defendant No. 2 through VC from Jail No. 14, Mandoli Jail. It is stated by defendant No. 2 that Madhu Aggarwal i.e. defendant No. 1 has expired in the year 2021. Let this fact be verified by the plaintiff. Further, defendant No. 2 seeks time to engage counsel. Let written statement within statutory period and reply to the application u/o 39 Rule1 & 2 CPC be filed after supplying advance copy to the opposite counsel against acknowledgment and thereafter, replication, if any, be also filed in same manner. At this stage, Ld. Counsel for the plaintiff presses directions thereby restraining the defendants from alienating, transferring or creating any 3rd party interest in the property free hold DDA Built LIG Flat No. 743, Ground Floor, Pocket GH-4, Sector-28, Category-A, Group-C, Rohini, Dehli (hereinafter called as suit property). On Court query, it is stated on behalf of defendant No. 2 that this property has not been sold so far. Ld. Counsel for the plaintiff has already filed a report dated 02.07.2025 filed by receiver appointed vide order dated 26.05.2026 by Ld. CJM, North-North, Rohini Courts, Delhi. Perused. As per this report, physical possession of the suit property was secured by the receiver and forwarded to secured creditor ie. plaintiff. Thus, considering the facts stated in the plaint, defendant -- 1 of 2 -- -2- No. 1 is hereby directed not to sell, alienate, transfer or create any 3rd party interest in the suit property, till the next date of hearing. Now, put up for further proceedings on 06.10.2026. Defendant No. 2 is at liberty to appear through VC. Jail Superintendent No. 14, Mandoli Jail is directed accordingly.
