Counsel for the applicant.
Reply to the instant application has been filed by the
State/IO. Same be taken on record. Copy supplied to the Ld. Counsel for
the applicant/accused.
This is an application for release of two mobile phones
Make I Phone 17 Pro Max and I Phone 12 Pro on superdari moved on
behalf of applicant Aryan Singh.
Reply/report on the aforesaid application received from the
IO who has stated that the aforesaid mobile phones are no longer
required for purposes of investigation and they have no objection if the
said mobile phones are released to the owner/applicant.
Heard and considered.
In view of the submissions made in the application and
report of the IO, mobile phones Make I Phone 17 Pro Max and I Phone
12 Pro be released to the applicant/registered owner on furnishing of
superdarinama in the sum of Rs. 5,000/- in compliance of judgment of
Hon'ble High Court in case titled Manjeet Singh V. State (Crl. MC No.
4485/2013) and Crl. M.C No. 16055/2013), subject to the following
conditions:

(I) The mobile phones in question be released to its owner/applicant
only subject to furnishing of security bond/indemnity bond to the
satisfaction of SHO/IO concerned
(II) IO shall prepare detailed Panchnama mentioning colour, appearance,
IMEI number of the mobile phones etc.
(III) IO shall take photographs of the mobile phones from different
angles and also of IMEI number of the mobile phones.
(IV) IO shall get the mobile phones from proper valuer and shall take
valuation report in this regard from valuer as per rule
The application stands disposed of accordingly. IO/SHO
to file the bond as well as the photographs of the vehicle-in-question in
the court within a week from the date of release.
Copy of this order be given Dasti to the parties.
