Present: Applicant with counsel Sh Paritosh Garg.
This is an application filed by the applicant stating that his heart
treatment is going on for which he requires funds, as he is in need of insertion
of a pacemaker. He request that out of the awarded amount lying in his
MACAD Annuity, at least Rs. 5 lakhs may be released to him. His separate
statement has been recorded to this effect.
Submission heard and record seen.
Though the treatment of applicant is an admitted fact as per
medical documents filed but it is also admitted fact that applicant is getting his
treatment from government hospital. Though, no estimate of treatment has
been filed on record, but considering that treatment of applicant is going on as
per medical documents filed on record, there is no legal impediment if a lump
sum amount is released to the applicant. Accordingly, the bank manager
concerned wherein the award amount of applicant is lying in MACAD
Annuity is directed to release only Rs. 1,00,000/- to the applicant to meet out
his medical expenses but the applicant would be allowed to withdraw this amount
only through withdrawal slip and by no other mode or digital mode i.e. Debit card /
Credit card /ATM/NEFT/RTGS/letter etc.
Copy of this order be sent to the bank manager concerned through
applicant for compliance. Copy of this order be given dasti.
Application is disposed off accordingly.
