Proxy counsel for the defendant states that he will file his
Vakalatnama during course of the day.
Let written statement be filed by the defendant along with
reply to the application u/o 39 rule 1 & 2 CPC within statutory time limit
with advance copy to counsel opposite at least a week before the next
date of hearing.
The defendant who is present in person states that he will
not alienate the suit property till the disposal of suit.
The defendant is restrained from alienating the suit
property till the disposal of the suit, so as to preserve the subject matter
of the case. Application u/o 39 Rule 1 & 2 CPC stands disposed off as
counsel for the plaintiff is satisfied by the statement of the defendant.
At request of proxy counsel for the defendant, to come up
for completion of pleadings, filing of affidavit of admission/denial of
documents and framing of issues on 05.06.2025.
