for the defendant.
The pleadings are complete. On the basis of the
pleadings, following issues are framed for trial :
1. Whether the plaintiff is entitled to the recovery of
Rs.1,95,41,238/- as prayed for ? OPP
2. Whether the plaintiff is entitled to any interest, if so, then
on what rate and for what period, as prayed for ? OPP
3. Whether the suit is barred by limitation ? OPD
4. Whether there is no cause of action in favour of the
plaintiff to file the present suit? OPD
5. Relief.
No other issue arises or is pressed for by the parties.
Let list of witnesses alongwith affidavits of the
witnesses be filed by both the parties within 10 days from today
with advance copy to the opposite party.
Put up for PE as well as for filing reply to the
aforesaid application u/o XXXVIII Rule 5 CPC with advance
copy to ld counsel for the plaintiff, on 23.07.24.
