Copy of the charge sheet has been supplied to the accused
against acknowledgment.
1. It is submitted by the Ld. Special PP for the State that an
application under Section 349 BNSS seeking voice sampling of accused
Sahidul Khan @ Babu Khan, Ahir Khan both S/o Hanif Khan and Head
Constable Sunny Sangwan, No.1349/Crime PS Crime Branch is pending
for adjudication.
2. Reply filed by the State to the present application is
already on record, wherein, State has not objected the present
application. However, State has prayed for also taking voice sampling of
one Mr. Hasan Chaudhary in the present case.
3. During the course of the proceedings, all three persons
namely Sahidul Khan @ Babu Khan, Ahir Khan and Head Constable
Sunny Sangwan, have given their no objection to the present application.
Their separate statements are already on record in this regard.
4. Considering the no objection given by the State in the
form of a reply as well as no objections given by accused Sahidul Khan
@ Babu Khan, Ahir Khan and Head Constable Sunny Sangwan, this

court is of the considered opinion that there is no impediment in allowing
the present application for the purpose of proper investigation of the
matter. In view of the same, the present application stands allowed.
5. IO is directed to take the necessary steps for collecting the
voice samples of the above said persons after producing them before the
concerned authority i.e. FSL, Rohini, Delhi with further direction to
procure the result of the same and file before the undersigned on or
before the NDOH.
Put up on 19.03.2026 for arguments on charge.
Copy of this order be given Dasti, as prayed for.

IO is directed to expedite the procurement of FSL report
and file the same in the form of supplementary charge sheet, if not filed
yet.
