Counsel for defendant no. 2 – DDA. 1. As per report on dasti service, the defendant no. 1 deemed to be served on 16/09/2025 as he refused service. 2. None is present on behalf of defendant no. 1. Defendant no.1 is proceeded ex-parte. 3. None is present on behalf of Sub-Registrar, defendant no. 3. Defendant no. 3 is proceeded ex-parte. 4. Ld. Counsel for plaintiff presses his application under Order 39 Rule 1 & 2 dated 14/02/2025 for restraining defendant no. 1 from creating third party interest over suit property. Plaintiff has placed on record additional documents. The same are taken on record, subject to all just objections. 5. Heard. File perused. 6. Plaintiff is the purchasor. Defendant no. 1 is the seller. Plaintiff had stated that he had received letter dated 26/09/2025 from defendant no. 1 who asked for balance payment and stated he is ready to do the needful. Plaintiff stated that despite readiness and willingness of the plaintiff, defendant did not come forward to execute Sale Deed. Plaintiff relies upon transfer dated -- 1 of 2 -- Contd….. -/2/- 27/09/2025 of Rs. 1.41 lacs. Plaintiff relies upon Account Statement of Bank of Baroda to show that around 37 lacs were readily available. 7. As stated above, defendant no. 1 is ex-parte. It is necessary to preserve the subject matter of the suit. The application under Order 39 Rule 1 & 2 CPC is disposed off with directions to defendant no. 1 no to create any third party interest over the suit property. 8. At request of Ld. Counsel for plaintiff, to come up for filing of replication to Written Statement of defendant no. 2, filing of affidavit of admission-denial of documents and framing of issues on 17/02/2026.
